The Committee reached out and strengthened ties to the Arbitration organizations in the Mainland China. The main highlights are:
Presention of a paper at 仲裁峰會 organized by CIETAC on 27-28 September 2016 in Beijing by Sylvia Siu.
Presentation of a paper at China Arbitration Week organized by CIETAC on 25 September 2016 in Beijing by Sylvia Siu.
In May 2016, Sylvia, attended a conference entitled "粵港調解實務研討會暨全市法院加強調解工作會議" in Dongguan to discuss alternative dispute resolution, in particular mediation.
In May 2016, Sylvia attended a forum entitled "深圳前海合作區人民法院訴調對接中心揭牌儀式暨第一屆前海涉港商事調解論壇" in Qianhai to discuss commercial mediation and was also one of the speakers.
In April 2016, Sylvia attended a conference organised by the American Bar Association Section of International Law in New York and was a panel speaker.
On 29 July 2015, a seminar was held at the HKIAC regarding the proposed "apology legislation", a topic which attracted and still attracts a lot of attention. In summary, the main objective of the proposed legislation is to promote and encourage the making of an apology in order to facilitate the amicable settlement of disputes by clarifying the legal consequences of doing so. The seminar was organised by the Hong Kong Institute of Arbitrators and FIDA was a supporting organisation along with four other organisations including the Chinese Women's Club. Sylvia Siu was one of the three speakers at the seminar, which was very well received.
A visit to the Shenzhen Court of International Arbitration in Qianhai on 31 January 2015 co-organized by our ADR Committee and China Committee. The visit has given us a great opportunity to exchange views with the Mainland bodies, and to hear more about the Mainland's interesting and meaningful developments on the legal front. We had a productive trip which including a meeting with Shenzhen Court of International Arbitration in Qianhai (SCIA), and lunch with Shenzhen Lawyers Association.
HKIArb Talk by the Hon Madam Justice Mimmie Chan on 18 August 2014 at HKIAC, 38/F Two Exchange Square, Central. The Talk given by the Hon Madam Justice Mimmie Chan provided us an in-depth analysis of the role of mediation in Courts of Hong Kong from a judiciary point of view.
As one of the supporting organizations for various talks organized by Hong Kong Institute of Arbitrators, FIDA has supported talks including -
The Regional Arbitral Institutes Forum (“RAIF”) held at the Grand Hyatt on 14 October 2017 (organized by HKIArb), many council members attended RAIF and met with representatives from overseas arbitration bodies.
“Mediation and the Entertainment Industry” Seminar at the Justice Place on 15 May 2018, organized by the Department of Justice. Chair Sylvia was a moderator of the Fire Chat session. Many council members attended the Seminar.
The 6th Greater China Arbitration Forum (GCAF), which took place May 5-7, 2015. The 6th GCAF aims at strengthening the cooperation and exchange of the Arbitration Institutes within the Greater China Region, and provides a golden opportunity for local arbitrators/mediators to meet representatives from leading arbitration institutes from PRC, Taiwan and Macao. Welcome Dinner took place at The Hong Kong Banker Club, 43/F, Gloucester Tower, The Landmark, on 5 May 2015;
“A view from the London Commercial Court: recent arbitration cases” by Sir Bernard Eder;
“Maritime Fraud” by Mr Stephen Hofmeyr QC and Mr. Andrew Wales QC; and
“An overview on English arbitration two particular issues: negotiation as a mandatory (contractual) preface to arbitration and the problem of public policy in the context of enforcement of foreign awards in English” by Professor Neil Andrews of Cambridge University.
